2. Types of Products

We offer three main categories of products:

A. Printed Products: posters, canvas prints, apparel, and other made-to-order printed items (“prints on support”).
B. Digital Products: digital files (artworks, illustrations, high-resolution images) delivered by secure link or email, including custom digital artworks.
C. Original Painted Commissions: one-of-one hand-painted physical artworks created according to your specifications.

3. Use of the Service and Accounts

Some parts of the Service may require an account. You agree to provide accurate, complete, and up-to-date information when creating your account, and to safeguard your login credentials. You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security at studio@monsieurcouleur.com.

4. Intellectual Property & Client Usage Rights

All artworks and content on the Service—whether digital, printed, or painted—remain the exclusive intellectual property of Nicolas Weber, unless otherwise agreed in writing. Purchasing a product does not transfer any copyright or commercial rights. You do not acquire ownership of the underlying artwork; you acquire a product and a limited license to use the artwork as described below.

4.1 Rights Granted to the Client

The customer is granted a personal, private, and reasonable reproduction right only, limited to:

displaying the artwork in a private, non-public space (e.g. at home);
printing a personal copy for private decoration;
storing or backing up digital files for personal, non-commercial use.

4.2 Strict Prohibitions

The customer is not allowed to:

reproduce the artwork for any commercial or advertising purpose;
sell, resell, rent, or redistribute the artwork, whether physical or digital;
print multiple copies for distribution or resale;
use the artwork in any commercial, promotional, or marketing context;
create derivative products or merchandise based on the artwork;
turn the artwork into NFTs or any tradeable digital asset;
remove, hide, or alter the artist’s signature, credits, or identifying marks.

Any use beyond personal, private usage requires prior written permission from the artist.

5. Third-Party Services

In using the Service, you may interact with third-party services, products, software, or applications (“Third-Party Services”), such as payment processors, hosting providers, or booking tools. Any use of Third-Party Services is at your own risk. We shall not be responsible or liable for any damage or loss caused or alleged to be caused by, or in connection with, the use of any such content, goods, or services available on or through any third-party websites or services.

6. Prices, Payment, and Currencies

Prices are displayed in the currency shown on the website (e.g. JPY, EUR, or USD). Payment is due at checkout and is processed via secure third-party payment providers. You are responsible for any bank fees, currency conversion fees, or additional charges applied by your payment provider.

7. Orders, Cancellations, and Product-Specific Conditions

You must carefully review all order details (product, size, options, address, etc.) before placing your order. The cancellation and refund conditions vary according to the product category:

Printed Products (A): not cancellable once production has started.
Digital Products (B): fully refundable if work has not started; 50% refundable if work has started; non-refundable after final delivery of the digital file.
Original Painted Commissions (C): not refundable once the creation process has begun, due to their fully custom nature.

8. No Withdrawal Right for Custom-Made Products

Products in categories A (Printed Products), B (Digital Products), and C (Original Painted Commissions) are made to order and/or customized to your specifications. They are therefore not eligible for any generic “change-of-mind” or withdrawal period.

9. Termination

We may terminate or suspend access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. You may stop using the Service at any time. Provisions which by their nature should survive termination (such as intellectual property, limitations of liability, etc.) shall remain in effect.

10. Disclaimer of Warranties and Limitation of Liability

Our Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that defects will be corrected. You understand that you use the Service at your own discretion and risk. To the fullest extent permitted by law, we disclaim all liability for any indirect, consequential, incidental, or special damages arising out of or in connection with your use of, or inability to use, the Service.

11. Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, this Agreement and any access to or use of the Service will be governed by the laws of Japan. The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of the Service will be the courts located in Japan.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we make material changes, we will notify you by posting on our website or by sending you an email before the changes take effect. Your continued use of the Service after the effective date of the new terms will constitute your acceptance of the revised Terms.

Shipping, Returns & Refund Policy

1. Printed Products (Category A)

1.1 Production and Shipping Times

Printed items (posters, canvas prints, apparel, etc.) are made to order.
Estimated times:

Production: approximately 2–7 business days
Shipping: varies depending on the destination country

1.2 Damaged, Defective, or Incorrect Items (14-Day Window)

If you receive a damaged, defective, misprinted, or incorrect item,
you must contact us within 14 days of delivery.

Please email studio@monsieurcouleur.com and include:

your order number;
a clear description of the issue;
photos of the product;
photos of the package if it is visibly damaged.

After review, we may offer a free replacement or a full refund,
depending on the situation.

1.3 Non-Eligible Returns

Due to the made-to-order nature of printed products, we do not accept returns in the following cases:

wrong size or model ordered by the customer;
change of mind or subjective dissatisfaction;
incorrect shipping address provided by the customer;
minor differences in color or placement inherent to printing processes.

These situations do not entitle you to a refund or replacement.

2. Digital Products (Category B)

2.1 Delivery

Digital products are delivered as one or more files via email or secure link,
after the final revision has been approved by the client.

2.2 Production Time

Creation time depends on project complexity and the number of revisions included in your chosen pack.
As a general guideline, expect approximately 1–2 weeks.

2.3 Cancellation and Refunds

If work has not yet started: you may receive a 100% refund.
If the artist has already started working: you may receive a
50% refund.
After final delivery of the digital file: the product is non-refundable.

Digital products cannot be returned once delivered.

3. Original Painted Commissions (Category C)

3.1 Creation Time

Standard production time is approximately 4 weeks, unless otherwise agreed (for urgent projects).
Timing may vary depending on size, complexity, and current workload.

3.2 Shipping

Artworks are shipped from Japan, with reinforced packaging, tracking, and insurance adapted to the artwork’s value.

3.3 Damaged Parcel Upon Delivery

If the parcel appears damaged on delivery, you must:

refuse the parcel, or sign with written reservations to the courier;
take photos of the parcel and the artwork;
contact us within 48 hours at
studio@monsieurcouleur.com.

A refund or replacement solution may be considered after we review the case and the evidence provided.

3.4 No Refunds Once Work Has Begun

Painted commissions are fully custom-made. Once the creation process has begun,
no refunds are possible, except in the case of proven damage in transit as described above.

4. Delivery Delays and Customs

Delays caused by carriers, customs, weather, or strikes cannot be used as grounds for a refund.
Any import taxes or customs duties are the responsibility of the customer.
